IMPORTANT CONSIDERATIONS UNDER CURRENT ADMINISTRATION

Given the current political climate, out of an abundance of caution, we strongly encourage that all foreign nationals carry a valid photo ID (passport or state ID) AND proof of their lawful status in the United States with them at all times. Specifically, as proof of lawful status, it is advisable that non-immigrants carry copies of their I-797 Approval Notices and their latest I-94 records confirming valid L, H, TN, TPS, DACA status, etc. F-1 students should carry their latest I-20’s. Those with pending applications for benefits such as pending I-485 applications or applications for extensions of stay or change of status should carry copies of their Receipt Notices. Lawful permanent residents/conditional permanent residents should carry their green cards.

INTERNATIONAL TRAVEL WARNINGS

At this time and for the foreseeable future, we strongly encourage our clients to reconsider nonessential international travel as we anticipate future travel restrictions, delays at U.S. Consulates/Embassies abroad, increased security screenings at airports, etc. Returning nonimmigrant visa holders (H, L, E, etc.), those entering on Advance Parole, and other employment-based visa holders who typically do not experience issues may now face new scrutiny when reentering the United States.

It is possible there could be delays in visa issuance at U.S. Consulates/Embassies abroad, requests for additional security clearances or more instances of administrative processing or return of approved petitions to USCIS for review. Those who need to apply for new visas abroad should be prepared to remain outside of the U.S. for an extended period of time due to processing delays.
We also anticipate an announcement of travel bans in the coming weeks directed at nationals of specific countries identified as “security risks” as was the case under the last Trump Administration. Travel restrictions may happen with no advance notice.
