As background, on January 4, 2023, USCIS issued a proposed rule on adjusting their fee schedule, which included increasing application fees by a 40% overall weighted average increase. On Monday, January 8, 2024, the White House Office of Information and Regulatory Affairs (OIRA) received the Final Rule outlining the increased fees for U.S. Citizenship and Immigration Services (USCIS) filings. It was announced that OIRA completed its review a few days ago. As such, we expect the Final Rule to be published in the next few days or weeks. Based on previous fee-related rules, once published in the Federal Register, the new fees will be effective 60 days later, as early as Spring 2024.
We will need to await publication of the Final Rule to confirm the exact amount of the fee increases but some of the increases are expected to be significant.
